‘Abdullāh ibn ‘Umar (may Allah be pleased with him) divorced his wife while she was menstruating. So, ‘Umar (may Allah be pleased with him) informed the Messenger of Allah (may Allah’s peace and blessings be upon him) about that, and he became furious at him

عن عبد الله بن عمر رضي الله عنهما : «أنه طلق امرأته وهي حائض، فذكر ذلك عمر لرسول الله صلى الله عليه وسلم ، فَتَغَيَّظَ منه رسول الله صلى الله عليه وسلم ، ثم قال: لِيُرَاجِعْهَا، ثم لِيُمْسِكْهَا حتى تَطْهُرَ، ثم تَحِيضُ فَتَطْهُرَ، فإن بدا له أن يطلقها فليطلقها طاهرًا قبل أن يَمَسَّهَا، فتلك العِدَّةُ، كما أمر الله عز وجل ». وفي لفظ: «حتى تَحِيضَ حَيْضَةً مُسْتَقْبَلَةً، سِوَى حَيْضَتِهَا التي طَلَّقَهَا فيها». وفي لفظ «فحُسِبَتْ من طلاقها، ورَاجَعْهَا عبدُ الله كما أمره رسول الله صلى الله عليه وسلم ».
‘Abdullāh ibn ‘Umar (may Allah be pleased with him) reported that he divorced his wife while she was menstruating. So, ‘Umar (may Allah be pleased with him) informed the Messenger of Allah (may Allah’s peace and blessings be upon him) about that, and he became furious at him and said: “Let him take her back and keep her until she becomes purified of menstruation, and then menstruates and then becomes purified of menstruation. Thereafter, if he decides to divorce her, he should divorce her while in a state of purity and before having intercourse with her. That is the ‘Iddah (post-divorce waiting period), as commanded by Allah, the Almighty. In another narration: “Until she enters the next menstrual period, other than the one during which he divorced her.” In yet another narration: “It was counted as one valid divorce, and ‘Abdullāh took her back at the command of the Messenger of Allah (may Allah’s peace and blessings be upon him).”

Explanation

‘Abdullāh ibn ‘Umar (may Allah be pleased with him) divorced his wife while having her menses. Thereupon, his father told the Prophet (may Allah's peace and blessings be upon him) about that, and he became extremely angry because he had divorced her in a manner that is unlawful and inconsistent with the Sunnah. Then, he commanded him to take her back and keep her until she would become purified after that menstrual period and would get another menses and then become purified of it. Afterwards, if he had no desire to keep her and decided to divorce her, he should do so before approaching her sexually. That is the period of abstention during which divorce can take place, as commanded by the Almighty Lord. Scholars differed over whether divorce of a menstruating woman is effective, even though it is unlawful and not in conformity with the Sunnah. The adopted view in this regard is the one based on the narration reported by Abu Dawūd and others: “He returned her to me and did not consider it to be anything.” This narration does not explicitly mention that the divorce was effective or was counted as such by the Prophet (may Allah’s peace and blessings be upon him). It is noteworthy here to cite the well-known Hadīth that reads: “If anyone does something contrary to our matter, it will be rejected.” [Al-Bukhāri and Muslim]

The (pronouncement) of three divorces during the lifetime of the Messenger of Allah (may Allah's peace and blessings be upon him) and that of Abu Bakr and two years of the caliphate of ‘Umar (was treated) as one

عن ابن عباس، قال: "كان الطلاق على عهد رسول الله صلى الله عليه وسلم ، وأبي بكر، وسنتين من خلافة عمر، طلاق الثلاث واحدة، فقال عمر بن الخطاب: إن الناس قد استعجلوا في أمر قد كانت لهم فيه أَنَاةٌ، فلو أَمْضَيْنَاهُ عليهم، فَأَمْضَاهُ عليهم".
Ibn ‘Abbās (may Allah be pleased with him) reported: The (pronouncement) of three divorces during the lifetime of the Messenger of Allah (may Allah's peace and blessings be upon him) and that of Abu Bakr and two years of the caliphate of ‘Umar (was treated) as one. Then ‘Umar ibn al-Khattāb said: "Indeed, people hasten to a matter in which they used to act with deliberation. So if we would count them as three divorces," and he did that.

Explanation

This Hadīth shows that the triple divorce that used to occur during the time of the Prophet, may Allah's peace and blessings be upon him; the Caliphate of Abu Bakr; and the two years of the caliphate of ‘Umar (may Allah be pleased with him) was considered as one divorce. That is, the three successive pronouncements of divorce would count as one. For example, if a man says to his wife: "You are divorced" three times at once, this counts as one consequential divorce. However, if a man said "You are divorced thrice," gathering the three times of divorce in a single statement, this was meaningless and of no effect, thus, it would count as a single incident of divorce. When people started to act ruthlessly with regard to divorce and used it excessively and flippantly, ‘Umar (may Allah be pleased with him) wanted to stop people from rushing to a triple divorce. Therefore, he counted the triple divorce as three incidents rather than one. The scholars said that the pronouncement of divorce that counted as three incidents of divorce during ‘Umar's time only counted as one before his time. That is because people would not resort to the triple divorce and rarely used it. However, during ‘Umar's time, people used it frequently, so ‘Umar made it effective and counted it as three.

You divorced (in a manner that is) against the Sunnah and took back (in a manner that is) against the Sunnah. Call someone to bear witness to her divorce and to her reunion, and do not do that again

عن عمران بن حصين رضي الله عنهما أنه سُئِلَ عن الرجل يُطلِّق امرأته، ثم يَقَعُ بها، ولم يُشْهِدْ على طلاقها، ولا على رَجْعَتِهَا، فقال: "طَلَّقْتَ لِغَيْرِ سُنَّةٍ، وَرَاجَعْتَ لِغَيْرِ سُنَّةٍ، أَشْهِدْ على طلاقها، وعلى رَجْعَتِهَا، ولا تَعُدْ".
‘Imrān ibn Husayn (may Allah be pleased with him) reported that he was asked about a person who divorced his wife and then had intercourse with her without calling any witnesses to the divorce or the reunion. He said: "You divorced (in a manner that is) against the Sunnah and took back (in a manner that is) against the Sunnah. Call someone to bear witness to her divorce and to her reunion, and do not do that again."

Explanation

In this Hadīth, ‘Imrān ibn Husayn (may Allah be pleased with him) was asked about a man who divorced his wife and then had intercourse with her after he took her back in marriage, but without calling anybody to witness either divorce or reunion. ‘Imrān (may Allah be pleased with him) answered that such a husband has violated the Sunnah in both cases as he has not brought witnesses to the divorce or to the reunion. He ordered him to bring witnesses for the divorce and the reunion and to avoid doing so again.
