عبدُ الله بنُ عمر رضي اللهُ عنهما «أَنَّ النَّبِي صلى الله عليه وسلم قَطَع فِي مِجَنٍّ قِيمَتُهُ -وَفِي لَفْظٍ: ثَمَنُهُ- ثَلاثَةُ دَرَاهِمَ».
‘Abdullāh ibn ‘Umar (may Allah be pleased with him) reported: The Prophet (may Allah’s peace and blessings be upon him) cut off (a thief's hand) for a shield that was worth three dirhams.

Explanation
Allah, the Exalted, protected people’s lives, honor, and money through penalties that deter the aggressors. Hence, the penalty of the thief (who steals money or property from a place where it had been put away) is the amputation of the organ used to take the stolen property. This penalty atones the sin of the thief and deters others who might think of following such despicable ways to earn a living. Alternatively, such people would change their minds and try to make money in legitimate and modest ways. Ultimately, there would be more fruitful work, the world will be cultivated, and souls will be dignified.
In order to protect people’s properties and lives, maintain security, and encourage people to invest their money and make profits, Allah, the Exalted, out of His Wisdom, set a certain limit for the value of the stolen money or property, which is a quarter of a gold dinar. This is equal to one gram and one sixteenth of a gram, because the dinar weighs 4.25 grams.

وَفِي لَفْظٍ «كانت امرأة تَسْتَعِيرُ المَتَاعَ وَتَجْحَدُهُ، فَأَمَرَ النبي صلى الله عليه وسلم بِقَطْعِ يَدِهَا».
‘Ā’ishah (may Allah be pleased with her) reported: The Quraysh were greatly concerned about the case of the Makhzūmi woman who had committed theft. They wondered who should intercede for her with the Messenger of Allah (may Allah’s peace and blessings be upon him). Some said: "Only Usāmah ibn Zayd, the Prophet’s beloved one, would dare do so." As Usāmah spoke to the Prophet (may Allah’s peace and blessings be upon him) about this issue, he said to him: "Do you intercede regarding one of the punishments prescribed by Allah?" Then, he got up and addressed the people, saying: "The people before you were ruined because if a noble person among them committed theft, they would leave him unpunished, but if a weak person among them committed theft, they would inflict the legal punishment on him. By Allah! Were Fātimah, the daughter of Muhammad, to commit theft, I would cut off her hand."
Another wording reads: "She was a woman who used to borrow things from people and deny having taken them. So, the Prophet (may Allah’s peace and blessings be upon him) ordered that her hand should be cut off.”

Explanation
A woman from Banu Makhzūm used to deceitfully borrow things from people and then deny taking anything. She once borrowed jewelry and denied having taken it. Yet, it was found in her possession. News of this reached the Prophet (may Allah’s peace and blessings be upon him) who resolved to inflict the prescribed punishment on her, by cutting off her hand. She was a noble woman from an honorable family in the Quraysh. Therefore, the Quraysh were concerned about her and the ruling to be executed against her. They consulted each other over who should be chosen as an intercessor before the Prophet (may Allah’s peace and blessings be upon him) on her behalf, seeking to relieve her from the punishment. They found no one more qualified than Usāmah ibn Zayd, for he was close and beloved to the Prophet (may Allah’s peace and blessings be upon him). He talked to him.
The Prophet (may Allah’s peace and blessings be upon him), became extremely angry with Usāmah and rebukingly said: “Would you intercede regarding one of the punishments prescribed by Allah?"
Then, he stood up and addressed the people to clarify to them the gravity of such intercession that aims at suspending the punishments set by the Almighty Lord. This was also because the matter concerned many of them. The Prophet (may Allah’s peace and blessings be upon him) informed them that the past nations were ruined, in terms of their religious and worldly affairs, because they used to inflict the legal punishments upon the poor and the weak and pardon the rich and the powerful. Therefore, chaos, evil, and corruption spread and prevailed among them, and they incurred the wrath of Allah, the Almighty, and deserved His punishment.
In a concluding statement, the Prophet (may Allah’s peace and blessings be upon him) swore that if his daughter Fātimah, the noblest among all women, committed such an act, he would definitely subject her to the legal punishment prescribed by Allah, the Almighty.

- Allah Almighty has determined the thief's punishment, which is cutting off his hand, as He says: {As for the thief, male or female, amputate their hands.} [Surat al-Mā’idah: 38] The Sunnah has clarified the conditions of such amputation.
- The word "hand" in the Hadīth refers to cutting off the palm from the joint between it and the forearm.
- One of the rationales behind cutting off a thief's hand is to protect people's property and deter other transgressors.
- A dinar is a Mithqāl (unit of weight) of gold, currently equivalent to 4.25 grams of 24-karat gold; thus, a quarter of a dinar is equal to a little over a gram.

The Hadīth indicates that the curse, which is being expelled and distanced from Allah’s mercy, is applicable to thieves. This is because a thief steals insignificant things like an egg and a rope and becomes accustomed to stealing small things and ends up stealing bigger things. This causes his hand to be cut off, and he deserves the invocation of curse which the Prophet (may Allah's peace and blessings be upon him) made against him, or the information that he is cursed.

This ḥadīth at HadeethEnc.comعن محمد بن يحيى بن حبان، أن عبدا سرق وَدِيَّاً من حَائِطِ رجل، فغرسه في حائط سيده، فخرج صاحب الوَدِيِّ يلتمس وديه، فوجده، فاسْتَعْدَى على العبد مروان بن الحكم، وهو أمير المدينة يومئذ، فسجن مروانُ العبدَ وأراد قَطْعَ يده، فانطلق سيد العبد إلى رافع بن خديج، فسأله عن ذلك، فأخبره أنه سمع رسول الله صلى الله عليه وسلم يقول: «لا قَطْعَ في ثَمَرْ، ولا كَثَرٍ»، فقال الرجل: إن مروان أخذ غلامي، وهو يريد قطع يده، وأنا أحب أن تمشي معي إليه فتخبره بالذي سمعتَ من رسول الله صلى الله عليه وسلم ، فمشى معه رافع بن خديجٍ حتى أتى مروان بن الحكم، فقال له رافع: سمعت رسول الله صلى الله عليه وسلم يقول: «لا قَطْعَ في ثَمَرٍ، ولا كَثَرٍ»، فأمر مروان بالعبد فأُرسل.
Muhammad ibn Yahya ibn Hibbān reported: A slave stole a plant of a palm-tree from the orchard of a man and planted it in the orchard of his master. The owner of the plant went out in search of the plant and found it. He sought help against the slave from Marwān ibn al-Hakam, who was the Governor of Madīnah at that time. Marwān confined the slave and intended to cut off his hand. The slave's master went to Rāfi‘ ibn Khadīj and asked him about that case. Rāfi‘ told him that he had heard the Messenger of Allah (may Allah's peace and blessings be upon him) say: "The hand is not to be cut off for taking fruit or Kathar (the pith of the palm-tree)." The man then said: "Marwān has seized my slave and wants to cut off his hand. I wish you would go with me to him and tell him what you have heard from the Messenger of Allah (may Allah’s peace and blessings be upon him)." Rāfi‘ ibn Khadīj went with him to Marwān ibn al-Hakam. Rāfi‘ said to him: "I heard the Messenger of Allah (may Allah’s peace and blessings be upon him) say: ‘The hand is not to be cut off for taking fruit or Kathar.'" So Marwān gave orders to release the slave, and he was released.

Explanation
A slave owned by a man stole a small palm-tree from the orchard of another man and planted it in the orchard of his master. When the owner of the stolen palm trees learned about theft, he wanted to take the slave to Marwān ibn al-Hakam, who was the Governor of Madīnah at that time, in order to have his hand cut off. However, upon the request of the slave's owner, Rāfi‘ ibn Khadīj (may Allah be pleased with him) told Marwān that the Prophet (may Allah's peace and blessings be upon him) mentioned that the hand is not to be cut off for taking fruit or pith of the palm-tree (a tissue in the stems of palm trees). Upon hearing that ruling which was authentically attributed to the Prophet (may Allah's peace and blessings be upon him) Marwān released the slave. This Hadīth proves that the hand of a thief is not to be cut off for taking fruits from an orchard or so, because the stolen item is not kept in a safe place.

‘Abdullāh ibn ‘Amr ibn al-‘Ās (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) was asked about fruit on the tree. He said: "Whatever a needy person eats without putting any in his pocket (and taking it away), there is no penalty on him. But whoever takes something away, he must pay a fine of twice its value and receive punishment. Whoever steals something after it has been stored properly, and its value amounts to the price of a shield, his hand must be cut off."

Explanation
The Prophet (may Allah's peace and blessings be upon him) was asked whether it is permissible to eat from the fruit on a tree that belongs to others. He said that picking something to eat immediately, without taking some of it in his clothes, is not punishable. The custom is that such a small amount is usually tolerated. However, if someone leaves an orchard, taking away an amount of produce with him, he has to guarantee it (i.e. pay its price) and receive punishment because he has taken something that is unlawful to him. Finally, taking an amount that is equal in value to a shield in the Prophet's time – which is the minimum amount for applying the corporal punishment for theft – from the storage and drying place, such an act is robbery and is punishable by cutting off the thief's hand, if the other conditions of cutting off are met.

Safwān ibn Umayyah (may Allah be pleased with him) reported: I was sleeping in the mosque while covered by a Khamīsah cloak of mine whose price was thirty dirhams. A man came and snatched it away from me. The man was seized and brought to the Messenger of Allah (may Allah’s peace and blessings be upon him) who ordered that his hand should be cut off. I came to him and said: "Will you cut off his hand for the sake of only thirty dirhams? I will sell it to him on credit." He said: "Why did you not say this before bringing him to me?"

Explanation
Safwān ibn Umayyah (may Allah be pleased with him) was sleeping in the mosque covered by his checked cloak. A thief swiftly snatched that cloak away, but he was caught and brought to the Messenger of Allah (may Allah’s peace and blessings be upon him) to be punished for theft. The Prophet (may Allah's peace and blessings be upon him) ordered that the hand of the thief should be cut off. It seems that Sawfān,(may Allah be pleased with him) felt sympathy for the thief, so he said to the Prophet (may Allah’s peace and blessings be upon him): "Will you cut off his hand for the sake of only thirty dirhams?" Then he suggested to sell the cloak to the thief on credit and give him time until he can pay its price. The Messenger of Allah (may Allah’s peace and blessings be upon him) said that this pardon should have been made before bringing the thief to him, because pardon is void if it is made after any of the prescribed corporal punishments is brought to the judge or ruler.
