Prescribed Punishment for Drinking Alcohol

A man who had drunk alcohol was brought to the Prophet (may Allah's peace and blessings be upon him) who hit him with a palm stalk with about forty lashes.

عن أنس بن مالك رضي الله عنه «أَنَ النّبي صلى الله عليه وسلم أُتِي بِرَجُل قَدْ شَرِب الْخَمْرَ، فَجَلَدَهُ بِجَريدة نحو أربعين»
Anas ibn Mālik (may Allah be pleased with him) reported: A man who had drunk alcohol was brought to the Prophet (may Allah's peace and blessings be upon him), who hit him with a palm stalk with about forty lashes.

Explanation

A man had drunk alcohol during the time of Prophet (may Allah's peace and blessings be upon him), who hit him with a palm stalk with about forty lashes as a legal punishment for drinking alcohol. In his reign, Abu Bakr (may Allah be pleased with him) applied the same number of lashes to a drunkard. When ‘Umar (may Allah be pleased with him) became a Caliph and the Muslims conquered several countries and mingled with others, drinking alcohol became widespread. So, ‘Umar (may Allah be pleased with him), as usual, consulted the scholars of the Companions on what punishment to apply on the drunkards to deter them from committing that sin. It was ‘Umar's habit to seek counsel on matters of importance that required personal legal reasoning. As the number of drunkards increased during the reign of ‘Umar, ‘Abdur-Rahmān ibn ‘Awf (may Allah be pleased with him) advised ‘Umar to increase the punishment of drunkards to eighty lashes so that it would become similar to the next lightest prescribed punishment, which is applicable to slanderers. So, ‘Umar (may Allah be pleased with him) increased the punishment of drunkards to eighty lashes, forty as a prescribed legal punishment, and forty as an additional discretionary punishment left to the discretion of the ruler (or judge), when necessary.

Every drink that intoxicates is unlawful.

عن عائشة رضي الله عنها: «أَنَّ رسول الله صلى الله عليه وسلم سُئِل عن الْبِتْعِ؟ فقال: كل شَرَابٍ أَسْكَر فهو حَرَامٌ».
‘Ā’ishah (may Allah be pleased with her) reported that the Messenger of Allah (may Allah’s peace and blessings be upon him) was asked about mead, and he said: "Every drink that intoxicates is unlawful."

Explanation

The Messenger of Allah (may Allah’s peace and blessings be upon him) was asked about mead, an alcoholic drink made of honey, and his answer was complete and comprehensive, to the effect that the difference of names does not matter as long as the meaning and essence is the same. Every drink that causes intoxication is forbidden wine, regardless of its kind or name. This Hadīth constitutes one of the concise and profound statements made by the Prophet (may Allah’s peace and blessings be upon him) as he demonstrated the rulings laid down by his Lord. The period of his prophet-hood contained such knowledge that would render all humanity blissful in the worldly life and in the Hereafter.

The prohibition of wine was revealed, which is made of five things: grapes, dates, honey, wheat, and barley.

عن عَبْدُ الله بن عمر رضي الله عنهما أن عمر قال -على منبر رسول الله- صلى الله عليه وسلم : "أما بعد، أيها الناس، إنه نزل تحريم الخمر وهي من خمسة: مِنَ العنب، والتمر، والعسل، والحنطة، والشعير. والخمر: مَا خَامَرَ العَقْلَ. ثَلاثٌ وَدِدْتُ أَنَّ رَسُولَ الله صلى الله عليه وسلم كَانَ عَهِدَ إلَيْنَا فِيهَا عَهْداً نَنْتَهِي إلَيْهِ: الجَدُّ، والكَلالَةُ، وأَبْوَابٌ مِنَ الرِّبَا".
‘Abdullāh ibn ‘Umar (may Allah be pleased with him) reported that ‘Umar, while standing on the Prophet's pulpit, said: "O people, the prohibition of wine was revealed, which is made of five things: grapes, dates, honey, wheat, and barley. Wine is anything that clouds the mind (i.e. intoxicates). There are three things that I wish the Messenger of Allah (may Allah's peace and blessings be upon him) had left us something decisive to which we would refer: the grandfather (his share of inheritance), the Kalālah (one who leaves neither ascendants nor descendants), and some questions related to usury."

Explanation

‘Umar ibn al-Khattāb (may Allah be pleased with him), standing on the Prophet's pulpit in his mosque, delivered a sermon in which he stated that wine is everything that intoxicates, not just wine that is made of grapes, rather, all intoxicating beverages made of dates, honey or wheat; are all considered wine. ‘Umar also mentioned in his sermon three problematic issues which he wished the Prophet had left a decisive ruling regarding them before his death. They are: the grandfather's share of inheritance, division of the estate of one who leaves neither ascendants nor descendants, and some questions related to usury. Praise be to Allah, the rulings on these three issues are known. This Hadīth does not mean that the Prophet (may Allah's peace and blessings be upon him) did not mention these issues at all, for he had indeed delivered the message and fulfilled the trust and conveyed from Allah matters that are less known and less significant than these three. However, ‘Umar only wished that the Prophet (may Allah's peace and blessings be upon him) had left an explicit statement regarding them that would not be subject to Ijtihād (independent reasoning).

عن أبي هريرة رضي الله عنه قال: أُتِي النبي صلى الله عليه وسلم برجل قد شَرِب خمرا، قال: «اضربوه». قال أبو هريرة: فمنا الضارب بيده، والضارب بنعله، والضارب بثوبه، فلما انصرف، قال بعض القوم: أخزاك الله، قال: «لا تقولوا هكذا، لا تُعِينُوا عليه الشيطان».
Abu Hurayrah (may Allah be pleased with him) reported that a man who drank wine was brought to the Prophet (may Allah's peace and blessings be upon him), who said: "Beat him." Abu Hurayrah added: "So some of us beat him with our hands, some with their sandals, and some with their garments (by twisting it like a lash). Then, when the man left, someone said: "May Allah disgrace you!" Upon that, the Prophet (may Allah's peace and blessings be upon him) said: "Do not say this! Do not help the devil to overpower him."

Explanation

The Companions (may Allah be pleased with them) brought to the Prophet (may Allah's peace and blessings be upon him) a man who was drinking alcohol. The Prophet ordered them to beat him without specifying the number of beats, so the Companions started beating him, some with their bare hands, some with their sandals to humiliate him, and others with their clothes. They did not use a whip which is used for a prescribed punishment. Then after they ceased beating him; one of them made a supplication against him, saying: "May Allah disgrace you", asking Allah to humiliate and expose him among the people. The Prophet (may Allah's peace and blessings be upon him) instructed them not to say so as that would be helping the devil against him. If they supplicated Allah to disgrace him, perhaps Allah would answer their supplication, and the devil would thus achieve his purpose and overpower the man. Also, this supplication may alienate the man after he had received the punishment.

عن أنس بن مالك رضي الله عنه «أن النبي صلى الله عليه وسلم أُتِيَ برجل قد شرب الخمر، فجلده بِجَرِيدَتَيْنِ نحو أربعين»، قال: وفعله أبو بكر، فلما كان عمر استشار الناس، فقال عبد الرحمن: أَخَفُّ الحدود ثمانين، «فأمر به عمر».
Anas ibn Mālik (may Allah be pleased with him) reported: A man who had drunk alcohol was brought to the Prophet (may Allah's peace and blessings be upon him) and he gave the man about forty lashes with two palm branches. Anas added: “Abu Bakr did the same, but when ‘Umar became the caliph, he consulted the people, and ‘Abdur-Rahmān ibn ‘Awf said: ‘The lightest prescribed punishment is eighty (lashes).' So ‘Umar gave his commands accordingly."

Explanation

The Hadīth indicated that the Prophet (may Allah's peace and blessings be upon him) gave a man who had drunk alcohol around forty lashes using palm branches. Abu Bakr (may Allah be pleased with him) applied the same punishment. However, when people started drinking more alcohol after the conquest of the Levant and other countries, where Muslims acquired many grapes and vineyards, ‘Umar (may Allah be pleased with him) consulted the Companions in regard to the punishment. When he consulted ‘Abdur-Rahmān ibn ‘Awf (may Allah be pleased with him), he said that the punishment for drinking alcohol should be escalated and the mildest punishment for drinking alcohol should be eighty lashes. Most of the Companions accepted this suggestion, and this opinion was adopted by the majority of Muslim jurists. The punishment for drinking alcohol was originally established by the Shariah and is not subject to Ijtihād (independent reasoning). Yet, the Ijtihād of the Companions (may Allah be pleased with him) was only used to increase the punishment when drinking alcohol intensified and became rampant and people were not deterred by the previous number of lashes.

Allah sent down the verse wherein He prohibited alcohol at a time when there was no other (intoxicant) drink in Madīnah except that prepared from dates

عن أنس بن مالك رضي الله عنه قال: «لقد أَنْزَلَ الله الآية التي حَرَّمَ الله فيها الخمر، وما بالمدينة شَرَابٌ يُشْرَبُ إلا من تَمْرٍ».

Explanation

In this Hadīth, Anas (may Allah be pleased with him) says that when Allah, the Almighty, revealed the verse that made alcohol unlawful to drink, there was no drink in Madīnah from which alcohol was produced except dates. This indicates that alcohol is prohibited because it causes intoxication, not because of the substance it is made from.

‘Ali ibn Abi Tālib (may Allah be pleased with him) reported: I would not blame myself for the death of any person when inflicting a prescribed corporal punishment on him, with the exception of the one who drinks alcohols, for if he were to die (when being punished), I would pay blood money to his family, because no punishment has been fixed by the Messenger of Allah (may Allah’s peace and blessings be upon him) for him

عن علي بن أبي طالب رضي الله عنه قال: «ما كنتُ لأقيمَ حَدّاً على أحد فيموت، فأجدَ في نَفسِي، إلا صاحب الخمر، فإنه لو مات وَدَيْتُهُ، وذلك أن رسول الله صلى الله عليه وسلم لم يَسُنَّهُ».

Explanation

In this Hadīth, ‘Ali (may Allah be pleased with him) stated that he would not feel sorry for a person who dies because of receiving a prescribed corporal punishment applied against him, except the one who drinks alcohols. If such a person died when being punished, ‘Ali (may Allah be pleased with him) would pay blood money to his family from the Muslim Treasury, since his penalty exceeded the deserved corporal punishment for drinking alcohols, which is the least prescribed punishment as to size and severity. Based on the Hadīth, no fixed punishment has been set by the Messenger of Allah (may Allah’s peace and blessings be upon him) for drinking alcohols. That being the case, it is considered a discretionary punishment and there is no liability if it led to the death of the penalized person. What was stated here by ‘Ali,(may Allah be pleased with him) is a precautionary procedure, regarding which other Companions disagreed with him.

Do not curse him, for by Allah, I know that he loves Allah and His Messenger

عَنْ عُمَرَ بْنِ الخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَجُلًا عَلَى عَهْدِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَانَ اسْمُهُ عَبْدَ اللَّهِ، وَكَانَ يُلَقَّبُ حِمَارًا، وَكَانَ يُضْحِكُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَكَانَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَدْ جَلَدَهُ فِي الشَّرَابِ، فَأُتِيَ بِهِ يَوْمًا فَأَمَرَ بِهِ فَجُلِدَ، فَقَالَ رَجُلٌ مِنَ القَوْمِ: اللَّهُمَّ الْعَنْهُ، مَا أَكْثَرَ مَا يُؤْتَى بِهِ؟ فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «لاَ تَلْعَنُوهُ، فَوَاللَّهِ مَا عَلِمْتُ أَنَّهُ يُحِبُّ اللَّهَ وَرَسُولَهُ».
‘Umar ibn al-Khattāb (may Allah be pleased with him) reported: A man at the time of the Prophet (ﷺ), whose name was ‘Abdullah and who was nicknamed Himār, used to make the Messenger of Allah (ﷺ) laugh. The Prophet (ﷺ) had flogged him for drinking (intoxicants). One day, he was brought again, and the Prophet (ﷺ) ordered that he be flogged. Then a man from among the people said: O Allah, curse him! How often is he brought? The Prophet (ﷺ) said: "Do not curse him, for by Allah, I know that he loves Allah and His Messenger."

Explanation

During the time of the Prophet (ﷺ), there was a man named ‘Abdullah, nicknamed Himār. He used to make the Prophet (ﷺ) laugh with some of his words. The Prophet (ﷺ) had flogged him for drinking wine, and one day he was brought again for drinking wine; the Prophet (ﷺ) ordered that he be flogged. One of those present insulted him and said: May Allah curse him! How often is he brought for drinking wine?! The Prophet (ﷺ) said: Do not supplicate for his expulsion from Allah's mercy. By Allah, I know nothing of him except that he loves Allah and His Messenger.

Benefits
  1. There is no contradiction between committing a prohibited act and having love for Allah and His Messenger in one's heart, for the Prophet (ﷺ) stated that the man mentioned loved Allah and His Messenger despite what he had done.
  2. One who commits a major sin and dies persisting in it is subject to Allah's will: if He wills, He will forgive him, and if He wills, He will punish him. Yet no one from the people of Islam will remain eternally in the Hellfire.
  3. It is disliked to curse a specific person who drinks wine, because there may be a reason preventing the curse from applying to him; moreover, cursing or supplicating against a specific individual may cause him to persist in sin or despair of accepting his repentance.
  4. It is permissible to curse, in general terms, those characterized by such a sin, without specifying any individual.
