Anas (may Allah be pleased with him) reported: We chased a rabbit at Marr Azh-Zhahrān. The people ran after it but they got tired. I ran after it and eventually caught it, and brought it to Abu Talhah. He then slaughtered it and sent its hip and two thighs to the Messenger of Allah (may Allah's peace and blessings be upon him) and he accepted them.

Explanation
The Prophet (may Allah's peace and blessings be upon him) and his Companions were on a journey. It appears that they rested in that place "Marr Azh-Zhahrān", the same place where they stopped to rest in the Year of the Conquest of Makkah. While they were there, they disturbed a rabbit. The people chased it to seize it, but they got tired and Anas continued till he caught it. At the time, Anas ibn Mālik was at the peak of his youth, so he seized it and took it to his stepfather, Abu Talhah (may Allah be pleased with him), who slaughtered it and sent its two thighs and hip as a gift to the Messenger of Allah (may Allah's peace and blessings be upon him), and he accepted it and perhaps ate from it.

The Messenger lifted his hand. I said: "O Messenger of Allah, is it forbidden?" He said: "No. Yet it is not found in the land of my people, and I feel that I have no liking for it." Khālid said: "I then chewed and ate it, while the Messenger was looking."

Explanation
Huzaylah ibn al-Hārith went to visit her sister Maymūnah bringing with her some gifts, including a roasted lizard. Joining this lunch were Maymūnah's nephews, including Khālid ibn al-Walīd. When the lunch was served and the Prophet (may Allah's peace and blessings be upon him) stretched his hand to eat, they told him about the type of food he was going to eat. Thereupon, he lifted his hand. So, Khālid asked whether this food was prohibited, and the Prophet replied in the negative, explaining that it was merely not found in the land of his people; that is why he did not feel like it. Then, Khālid began to chew and eat it while the Prophet was looking.

Asmā’ bint Abu Bakr (may Allah be pleased with her) reports that during the Prophet's lifetime, they slaughtered a horse and ate it. This proves the lawfulness of eating horse meat. Therefore, no one should mistakenly believe that horse meat is unlawful to eat just because horses are mentioned along with donkeys and mules in the verse where Allah, the Exalted, says: {And the horses, mules, and donkeys are for you to ride, and as adornment. And He creates what you do not know.} [An-Nahl: 8]

Explanation
Jābir ibn ‘Abdullāh (may Allah be pleased with him) heard the Prophet (may Allah's peace and blessings be upon him) say in the year of the Conquest, while he was in Makkah: Allah and His Messenger have forbidden the sale of wine, dead animals, pork, and idols. It was said: O Messenger of Allah, is it permissible to sell the fat of dead animals? It is used to coat ships and daub hides, and people light their lamps with it. He said: No, selling it is forbidden. Then, the Prophet (may Allah's peace and blessings be upon him) said: May Allah destroy the Jews and curse them. When Allah forbade them the fat of animals, they melted it and then sold its fat and consumed its price.
Benefits
- An-Nawawi said: Dead animals, alcohol, and swine: Muslims unanimously agreed over the prohibition of selling each of them.
- Al-Qādi said: This Hadīth indicates that what is not lawful to eat and utilize is not permissible to sell or consume from its profits, as is the case with the fat mentioned in the Hadīth.
- Ibn Hajar said: Its context gives a strong feeling, as interpreted by the majority of scholars, that "it is forbidden" refers to selling, not utilizing.
- Every means that leads to making something unlawful as lawful is wrong.
- The scholars said: Falling under the general prohibition of selling dead animals is the prohibition to sell the dead body of a disbeliever, if we kill him and the disbelievers ask to buy him or pay compensation for him. It is reported in a Hadīth that Nawfal ibn ‘Abdullāh al-Makhzūmi was killed by Muslims during the battle of the Trench, and the disbelievers paid to the Prophet (may Allah's peace and blessings be upon him) ten thousand Dirhams for his body, but he did not take it, and he gave the body to them.

Abu ‘Abdullāh Jābir ibn ‘Abdullāh (may Allah be pleased with him) reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) dispatched us to intercept a caravan belonging to Quraysh, and he appointed Abu ‘Ubaydah (may Allah be pleased with him) as our commander. He gave us a sack of dates as provision, other than which he did not find anything for us. Abu ‘Ubaydah used to give us one date at a time. He was asked: “What did you use to do with it?” He said: “We used to suck it just as a baby suckles, then we would drink some water after it, which would suffice us for a day until the night. We also used to beat off tree leaves with our sticks, then soak them in water and eat them.” He continued: “We then headed towards the sea coast, where something like a huge mound appeared to us. When we came to it, we found that it was an animal called 'Al-‘Anbar' (sperm whale). Abu ‘Ubaydah said: "It is a dead animal." Then he said: "No, rather we are the messengers of the Messenger of Allah (may Allah’s peace and blessings be upon him) and we have gone out in the cause of Allah. Now you are forced by necessity, so you can eat." We kept on eating from it for a month until we fattened up, and we were three hundred men. And indeed, I saw how we scooped out fat from the cavity of its eye in pitchers, then we would cut pieces from it like a bull or the size of a bull. Abu ‘Ubaydah took thirteen men from us and seated them in the cavity of its eye. He took one of its ribs and fixed it up, then saddled the largest camel of ours and it passed under it (the rib). We took large pieces of its meat as provision for our journey back home. When we arrived at Madīnah, we came to the Messenger of Allah (may Allah’s peace and blessings be upon him) and mentioned all of that to him. Thereupon, he said: "It is sustenance that Allah brought out for you. Do you have anything from its meat with you, so that you would feed us?" We sent some of its meat to the Messenger of Allah (may Allah’s peace and blessings be upon him) which he ate.

Explanation
The Prophet (may Allah's peace and blessings be upon him) sent a detachment to overtake a caravan that was carrying wheat and food for Quraysh. He appointed Abu ‘Ubaydah as their commander. The Prophet (may Allah's peace and blessings be upon him) gave them a leather sack of dates, and their commander used to give each one of them one date, due to the scarcity of the provisions they had. They would suck the dates and drink water over them. They also used to pluck the leaves off the trees by their sticks, which are the camels' fodder, then soak them in water to soften them up. When they arrived at the sea shore, they saw something like a mound of sand. When they reached it, they found out that it was a large fish called 'Al-‘Anbar' (sperm whale). Their commander Abu ‘Ubaydah forbade them from eating from it because it was dead, and dead animals are unlawful according to the Qur’anic texts. Then, he changed his ruling and allowed them to eat from it, because it is permissible for the Muslim to eat dead animals when he is forced by necessity, particularly they were on a journey that was an act of obedience to Allah, the Exalted. They forgot that the dead animals of the sea are lawful. Based on necessity, they ate from it and carried some of its meat with them. When they arrived at Madīnah, they informed the Messenger of Allah (may Allah’s peace and blessings be upon him) of that incident, whereupon he approved their action and ate from it.
