‘Umar ibn al-Khattāb (may Allah be pleased with him) consulted the people about a woman who was caused to miscarry.

عَنْ عُمَرَ بْنِ الْخَطَّابِ رضي الله عنه أَنَّهُ اسْتَشَارَ النَّاسَ فِي إمْلاصِ الْمَرْأَةِ، فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ: «شَهِدْت النَّبِيَّ صلى الله عليه وسلم قَضَى فِيهِ بِغُرَّةٍ- عَبْدٍ أَوْ أَمَةٍ- فَقَالَ: ائتني بِمَنْ يَشْهَدُ مَعَك، فَشَهِدَ مَعَهُ مُحَمَّدُ بْنُ مَسْلَمَةَ».
‘Umar ibn al-Khattāb (may Allah be pleased with him) consulted the people about a woman who was caused to miscarry. Al-Mughīrah ibn Shu‘bah said: "I witnessed the Prophet (may Allah's peace and blessings be upon him) passed a rule that a slave, male or female, be given as blood money." ‘Umar said: "Bring me someone to testify along with you." So, he brought Muhammad ibn Maslamah, who testified with him.

Explanation

A woman had a miscarriage before the delivery was due and lost her fetus as a result of a crime committed against her. It was usual for the just leader ‘Umar ibn al-Khattāb (may Allah be pleased with him) to consult his companions and the knowledgeable among them concerning his affairs and issues. So, when this woman miscarried her incomplete, dead fetus, he was unsure about the ruling concerning its blood money. So, he consulted the Companions (may Allah be pleased with them,) on this matter. Al-Mughīrah ibn Shu‘bah informed him that he witnessed the Prophet (may Allah's peace and blessings be upon him) rule that a male or female slave should be given as the fetus' blood money. So, ‘Umar wished to verify this ruling, which was to be a general legislation until the Day of Resurrection. So, he emphatically asked Al-Mughīrah to bring someone who would testify to the truthfulness of his statement and its accurate conveyance. Muhammad ibn Maslamah al-Ansāri testified to the truthfulness of what Al-Mughīrah had said - (may Allah be pleased with all of them).

Two women from the Hudhayl tribe fought each other. One of them threw a stone at the other, killing her along with what was in her womb.

عن أبي هُرَيْرة رضي الله عنه قال: «اقْتَتَلَتْ امْرَأَتَانِ مِنْ هُذَيْلٍ، فرمَت إحداهما الأخرى بحجر، فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمُوا إلَى النَّبِيِّ صلى الله عليه وسلم فَقَضَى رسول الله: أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ- عَبْدٌ، أَوْ وَلِيدَةٌ- وَقَضَى بِدِيَةِ المرأة على عَاقِلَتِهَا، وَوَرَّثَهَا وَلَدَهَا وَمَنْ مَعَهُمْ، فَقَامَ حَمَلُ بنُ النَّابِغَةِ الهُذَلِيُّ، فَقَالَ: يا رسول الله، كيف أغرم من لا شَرِبَ وَلا أَكَلَ، وَلا نَطَقَ وَلا اسْتَهَلَّ، فَمِثْلُ ذَلِكَ يُطَلُّ؟ فقال رَسول الله صلى الله عليه وسلم : «إنما هذا من إخوان الكُهَّان» من أجْل سَجْعِهِ الَّذِي سَجَعَ.
Abu Hurayrah (may Allah be pleased with him) reported: Two women from the Hudhayl tribe fought each other. One of them threw a stone at the other, killing her along with what was in her womb. They brought their case to the Messenger of Allah (may Allah's peace and blessings be upon him), who gave judgment that a male or female slave of the best quality should be given as blood money for her unborn child. He decided that the blood money of the killed woman should be paid by the other woman's male relatives on the father's side. He made her children and those who were with them among her heirs. Hamal ibn Mālik ibn An-Nābighah al-Hudhali said: "O Messenger of Allah, how should I be fined for one who has not drunk, eaten, spoken, or raised his voice with crying upon childbirth? Such an offense should be overlooked." Thereupon, the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Definitely, this man belongs to the diviners," given his use of rhymed phrases.

Explanation

Two women, co-wives from the Hudhayl tribe fought each other. One of them threw a little stone that does not normally cause death at the other, but it killed her along with the fetus that she had in her womb. The Prophet (may Allah's peace and blessings be upon him) judged that the blood money of the fetus is a male or female slave, whether the fetus was male or female, to be paid by the killer. Moreover, he judged that blood money was due for the killed woman, as the killing was semi-intentional, and that it should be paid by the killer’s male relatives on the father's side, since their relationship is based upon mutual support and equity, and because the murder was unintentional. Since the blood money was an inheritance related to the killed woman, it was given to her children and other rightful inheritors. However, her male relatives on the father’s side were entitled to nothing thereof. Upon that, Hamal ibn An-Nābighah, the killer’s father, said: "O Messenger of Allah, how could we be obliged to pay blood money for one who died before birth, and he did not eat, drink, or make any utterance so that it could be known THAT he was alive!" He made this statement in an oratory rhymed style. The Prophet (may Allah's peace and blessings be upon him) apparently disliked this man's statement, which implied his rejection of the Shar‘i rulings and involved use of rhymed phrases resembling those employed by diviners as a means whereby they devour people’s wealth unlawfully.

One of you bites his brother like a male camel does! There is no blood money for you.

عن عمران بن حصين رضي الله عنهما «أن رجلا عَضَّ يَدَ رجل؛ فَنَزَعَ يَدَهُ من فِيهِ؛ فوقعت ثَنِيَّتُهُ؛ فاختصما إلى النبي صلى الله عليه وسلم فقال: يَعَضُّ أحدُكم أخاه كما يَعَضُّ الفَحْلُ؛ لا دِيَةَ لك».
‘Imrān ibn Husayn (may Allah be pleased with him) reported: A man bit another man's hand, so the latter pulled his hand out of his mouth by force, causing two of the former's incisors to fall out. They referred their dispute to the Prophet (may Allah's peace and blessings be upon him), who said: "One of you bites his brother like a male camel does! There is no blood money for you."

Explanation

A man attacked another man and bit his hand. The one who was bitten pulled his hand by force from the other man's mouth, causing his two incisors to fall out. They submitted their case to the Prophet (may Allah's peace and blessings be upon him). The one who bit the man's hand was claiming blood money for his two teeth that fell out, whereas the other man defended himself saying that he only wanted to save his hand from the other man's teeth. The Prophet (may Allah's peace and blessings be upon him) refuted the claim of the former and expressed his discontent at what he had done, likening that to the attitude of fierce animals. He said: "One of you bites his brother like a male camel does! There is no blood money for you." Because the one who starts is the aggressor.

Whoever is killed in ambiguous circumstances, or when people are throwing stones, or by a whip, his blood money is the blood money of unpremeditated killing. Whoever is killed intentionally, retaliation becomes due. If anyone tries to prevent it, upon him is the curse of Allah, the angels, and all people

عن ابن عباس، قال: قال رسول الله صلى الله عليه وسلم : «من قُتِلَ في عِمِّيّا، أو رِمِّيَاً يكون بينهم بحَجَرٍ، أو بِسَوْطٍ، فَعَقْلُهُ عَقْلُ خطإ، ومن قَتَلَ عَمْدَاً فَقَوَدُ يَدَيْهِ، فمن حَالَ بينه وبينه فعليه لعنة الله، والملائكة والناس أجمعين».
‘Abdullāh ibn Abbās (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: ''Whoever is killed in ambiguous circumstances, or when people are throwing stones, or by a whip, his blood money is the blood money of unpremeditated killing. Whoever is killed intentionally, retaliation becomes due. If anyone tries to prevent it, upon him is the curse of Allah, the angels, and all people.”

Explanation

This Hadīth shows that anyone who is killed among people who were throwing objects at each other, or killed in ambiguous circumstances due to crowd or the like, and the killer is unknown, then the blood money will be like that of accidental murder, to be reimbursed by the Muslim treasury. However, in case of intentional killing, legal retribution is due. Anyone who prevents the guardians of the killed person from taking retribution, after having demanded it, has exposed himself to divine curse. Allah will not accept his repentance, religious duties, or voluntary good deeds, due to the gravity of his crime.

Whoever intentionally kills a believer shall be handed to the guardians of the killed person: if they will, they may kill him, and if they will, they may accept the blood money. [The blood money] is thirty 'Hiqqah', thirty 'Jadha‘ah', and forty 'Khalifah'. And whatever they agree upon shall be given to them

عن عمرو بن شعيب، عن أبيه، عن جده، أن رسول الله صلى الله عليه وسلم قال: «مَنْ قَتَل مؤمِنا متعمِّدًا دُفِعَ إلى أولياء المَقْتول، فإنْ شاءوا قَتَلوا، وإنْ شاءوا أَخَذوا الدِّيَة، وهي ثلاثون حِقَّة، وثلاثون جَذَعَة، وأَرْبعون خَلِفَة، وما صالحوا عليه فهو لهم، وذلك لتَشْدِيد العَقْل».
‘Amr ibn Shu‘ayb reported from his father, from his grandfather, that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Whoever intentionally kills a believer shall be handed to the guardians of the killed person: if they will, they may kill him, and if they will, they may accept the blood money. [The blood money] is thirty 'Hiqqah', thirty 'Jadha‘ah', and forty 'Khalifah'. And whatever they agree upon shall be given to them. That is because the blood money [in this case] should be exorbitant."

Explanation

This Hadīth shows the ruling subsequent to killing a believer intentionally. The guardians of the killed person, from among his heirs, have two options. They may ask for legal retribution, so the judge kills him; a punishment that resembles his crime. Otherwise, they can accept the blood money that is mentioned in the Hadīth: thirty 'Hiqqah' she-camels ('Hiqqah' is a she-camel in its fourth year of age), thirty 'Jadha‘ah' she-camels ('Jadha‘ah' is a she-camel in its fifth year of age), and forty pregnant she-camels. The guardians of the killed person may also accept an extra amount that they agree upon with the payers of the blood money. This is because the blood money for intentional killing is aggravated due to the perpetrator's intent and determination to kill the victim.

Beware! Every object of pride of the pre-Islamic times, whether it is blood-vengeance or property, or mentioned or claimed, has been put under my feet, except the supply of water to pilgrims and the custody of the House

عن عبد الله بن عمرو رضي الله عنهما أن رسول الله صلى الله عليه وسلم خطب يوم الفتح فقال: «ألا إن كل مَأْثُرَة كانت في الجاهلية من دم أو مال تُذْكَرُ وَتُدْعَى تحت قدمي، إلا ما كان من سِقَايَةِ الحاج، وسِدَانَة البيت» ثم قال: «ألا إن دِيَةَ الخطإ شِبْه العمد ما كان بالسَّوْطِ والعَصَا مِائة من الإبل: منها أربعون في بُطُونِهَا أولادُهَا».
‘Abdullāh ibn ‘Amr ibn al-‘Ās (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Beware! Every object of pride of the pre-Islamic times, whether it is blood-vengeance or property, or mentioned or claimed, has been put under my feet, except the supply of water to pilgrims and the custody of the House." He then said: "Beware! The blood-money for unintentional killing, such as is done with a whip and stick, is one hundred camels, forty of which are pregnant."

Explanation

The Messenger of Allah (may Allah's peace and blessings be upon him) said in his speech on the Day of the Conquest of Makkah that everything that is proudly mentioned of the pre-Islamic times is void and worthless. The only exceptions are supplying pilgrims with water and serving the Sacred House. These two things would maintain their previous status. In the pre-Islamic times, the Hijābah (general maintenance of the Ka‘bah) belonged to the Banu ‘Abd Ad-Dār, and the Siqāyah (providing water for the pilgrims) belonged to the Banu Hāshim. So the Prophet (may Allah's peace and blessings be upon him) approved such assignments. Then he mentioned that the semi-intentional killing, which is to hit someone with a tool that does not kill, such as a whip or a stick, entails full blood money, meaning one hundred camels, forty of which are pregnant.

This and that are equal; meaning the pinky finger and the thumb

عن ابن عباس رضي الله عنهما عن النبي صلى الله عليه وسلم قال: «هذه وهذه سواءٌ». يعني: الْخِنْصَر وَالْإِبْهَام.
Ibn ‘Abbās (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "This and that are equal; meaning the pinky finger and the thumb."

Explanation

There are ten fingers in the two hands. If a finger is cut off, the perpetrator must pay one tenth of the blood money given for a camel. There is no difference between any of the fingers. The pinky finger, which is the smallest finger, located at the external point of the palm, and the thumb, which is a big finger that is mainly used in holing stuff, striking, and other purposes, are equal in regards to blood money. If all the fingers of the two hands are cut off or damaged, the perpetrator has to pay the complete amount of blood money. The two feet are the same as the hands. As for the fingers, although they are obviously different and each of them has a job which could not be done by the other, all of them are equal with regard to blood money. Indeed Allah is All-Knowing and All-Aware.

The blood money of a Mu‘āhad is half the blood money of a free Muslim

عن عبد الله بن عمرو رضي الله عنهما أن النبي صلى الله عليه وسلم قال: «دِيَة المُعَاهِدِ نصف دِيَة الحُرِّ».
‘Abdullāh ibn ‘Amr (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: ''The blood money of a Mu‘āhad (someone who lives in non-Muslim lands and is committed to a peace treaty with Muslims) is half the blood money of a free Muslim.''

Explanation

The Prophet (may Allah's peace and blessings be upon him) said that the blood money of a Jew or Christian is half the blood money of a free Muslim person. This applies to a Dhimmi, i.e. a non-Muslim who is given a promise of protection to live in Muslim lands in return for paying a tribute and abiding by the rules of Islam; a Mu‘āhad; or a Musta'man, i.e. a disbeliever who enters the lands of Muslims under a pact of protection for trade or other purposes. All three categories are entitled to blood money because they share the status of having their blood protected. Their wounds are also to be compensated according to their blood money, just as the wounds of Muslims are compensated according to their blood money, since wounds are relevant to killing. The blood money of a non-Muslim man is fifty camels and of a non-Muslim woman is twenty five, for the blood money of women is half that of men. No blood money or legal retribution applies in the case of a belligerent non-Muslim who is at war with Muslims.

  1. ‘Umar ibn al-Khattāb (may Allah be pleased with him) consulted the people about a woman who was caused to miscarry.
  2. Two women from the Hudhayl tribe fought each other. One of them threw a stone at the other, killing her along with what was in her womb.
  3. One of you bites his brother like a male camel does! There is no blood money for you.
  4. Whoever is killed in ambiguous circumstances, or when people are throwing stones, or by a whip, his blood money is the blood money of unpremeditated killing.   6. Beware! Every object of pride of the pre-Islamic times, whether it is blood-vengeance or property, or mentioned or claimed, has been put under my feet, except the supply of water to pilgrims and the custody of the House

  9. The blood money of the semi-intentional killing is as aggravated as that of intentional killing, but the perpetrator is not to be killed. This happens when the devil stirs enmity between people, causing them to shed blood but not due to grudge or carrying weapons in fighting
