عن أنَسُ بنُ مالك رضي الله عنه قال: «أَنَّ جَارِيَةً وُجِدَ رَأْسُهَا مَرْضُوضاً بَيْنَ حَجَرَيْنِ، فَقِيلَ من فَعَلَ هَذَا بِك: فُلانٌ، فُلانٌ؟ حَتَّى ذُكِرَ يَهُودِيٌّ، فَأَوْمَأَتْ بِرَأْسِهَا، فَأُخِذَ الْيَهُودِيُّ فَاعْترف، فَأَمَرَ النَّبِي صلى الله عليه وسلم أَنْ يُرَضَّ رَأْسَهُ بَيْنَ حَجَرَيْنِ».
وَلِمُسْلِمٍ وَالنَّسَائِيَّ «أَنَّ يَهُودِيّاً قَتَلَ جَارِيَةً عَلَى أَوْضَاحٍ، فَأَقَادَهُ رَسُولُ الله».
Anas ibn Mālik (may Allah be pleased with him) reported: A girl was found with her head crushed between two stones. They asked her: "Who did that to you? Is it so-and-so, or so-and-so?" They kept mentioning names until they mentioned the name of a Jew, whereupon she nodded her head. The Jew was captured, and he confessed. Thereupon, the Messenger of Allah (may Allah's peace and blessings be upon him) ordered that his head be crushed between two stones. In another narration by Muslim and An-Nasā'i: "A Jew killed a girl for her jewelry, so the Messenger of Allah (may Allah's peace and blessings be upon him) killed him in retaliation for her."

Explanation
During the time of the Prophet (may Allah's peace and blessings be upon him), a girl whose head was crushed between two stones was found while she was still alive. They asked her about the perpetrator by mentioning some names of those who could have done that to her. When the name of a Jewish man was mentioned, she nodded her head, meaning that he was the perpetrator. He was thus accused of killing her. They captured him, and he confessed that he had killed her in order to steal silver jewelry which she was wearing. The Prophet (may Allah's peace and blessings be upon him) ordered that he should be killed in exactly the same manner in which he killed that girl in retaliation for her. Thus, his head was crushed between two stones.

The Prophet (may Allah's peace and blessings be upon him) says that if someone looks at another from behind a door, from above a wall or something, without his permission, and then one gouges out his eye with a pebble or a skewer, this physical damage will not incur a sin or retribution on its doer. This is because the peeper is the aggressor and guilty for violating the other person's privacy.

Explanation
This Hadīth highlights the inviolability of the blood of Muslims who testify that there is no god but Allah and that Muhammad is His messenger and do not do any of the acts that constitute a violation of the testimonies of Islam. The Wise Lawgiver advocated the safeguarding and protection of lives. Thus, He made such protection and safeguarding part of His legislation. Also, He declared that the gravest sin after polytheism is the killing of a soul which Allah has forbidden to kill. Hence, it is forbidden to kill a Muslim who affirm the two testimonies unless he commits one of three things:
1. Commit unlawful sexual intercourse after Allah has bestowed chastity upon him by virtue of a valid marriage.
2. Kill someone whose life is protected by the Shariah, out of injustice and aggression. Justice requires that the killer is to be killed in order to deter the transgressors from their aggression.
3. Disassociate himself from the Muslim community and go out in rebellion against Allah and His Messenger by committing highway robbery, scaring people, and spreading corruption on earth. The perpetrator is to be killed, crucified, or exiled so that the people become safe from his evil and transgression.
These three categories of people are to be killed, for killing them maintains safety of the religion, lives, and honor.

Qays ibn ‘Abbād reported: Al-Ashtar and I went to ‘Ali (may Allah be pleased with him) and said to him: "Has the Messenger of Allah (may Allah's peace and blessings be upon him) given you anything exclusive that he did not give to the people in general?" He said: "No, except what is in this document of mine." Mūsaddad said: "He then took out a document." Ahmad said: "A document from the sheath of his sword." It stipulated that "the lives of all Muslims are equal; they are one hand against the others. The covenant (given by even the) lowliest of them must be respected. Behold, a Muslim must not be killed for a disbeliever, nor must one who has been given a covenant be killed while his covenant is still in force. If anyone introduces an evil, he will be responsible for it. Whoever introduces an evil deed or shelters a perpetrator incurs the curse of Allah, His Angels, and all the people."

Explanation
This Hadīth indicates that some of the Tābi‘īn asked ‘Ali (may Allah be pleased with him) a question similar to that asked by Abu Juhayfah (may Allah be pleased with him) on another occasion. He asked if the Messenger of Allah (may Allah's peace and blessings be upon him) had given ‘Ali any exclusive knowledge different from the Qur’an? ‘Ali (may Allah be pleased with him) answered in the negative, affirming that he had nothing but a sheet on which were some rulings which ‘Ali had written from the Messenger of Allah (may Allah's peace and blessings be upon him). These included the ruling that the lives of all Muslims are equal, such that a Muslim would be killed for killing any Muslim. However, a Muslim would not be killed for killing a disbeliever, for a disbeliever is not equal to a Muslim in the inviolability of their blood. Also, the covenant of any Muslim is to be respected, whether it is given by a junior or a senior person, by a man or a woman. So if a Muslim gives a covenant of protection to someone, even if the person who is to be protected is a disbeliever, the covenant must be honored. It is not permissible to kill anyone who enters the lands of Islam under a covenant, for his life has been protected by virtue of this covenant. Anyone who does an evil deed or hides or shelters the perpetrator incurs the curse of Allah, the Angels, and all people. This means that he shall be dismissed from the mercy of Allah, the Exalted.

‘Imrān ibn Husayn narrated that a slave belonging to some poor people cut off the ear of another slave belonging to some rich people, so the owners of the perpetrator came to the Prophet (may Allah's peace and blessings be upon him) and said: "O Messenger of Allah, we are poor." The Prophet (may Allah's peace and blessings be upon him) did not stipulate any compensation to be paid by the perpetrator.

Explanation
The Hadīth relates that a slave or a small boy belonging to some poor people cut off the ear of his peer who belonged to rich people. The owners of the former went to the Prophet (may Allah's peace and blessings be upon him) and informed him of the fact that they were poor. The Prophet (may Allah's peace and blessings be upon him) did not stipulate any compensation for the owners of the victim. The reason for that was that the offender was young, and his action did not necessitate punishment. Some scholars stated that legal retribution was not carried out in this case because the offender was young. However, the blood money due on crimes less than murder still had to be paid by his male paternal relatives, who were poor. Therefore, the Prophet (may Allah's peace and blessings be upon him) absolved them from paying the indemnity. Moreover, an intentional crime by a young boy takes the ruling of crimes committed by mistake according to the consensus of the scholars. Therefore, blood money was not due on his male paternal relatives because they were poor; meanwhile, blood money is due on the male paternal relatives who are rich. The Prophet (may Allah's peace and blessings be upon him) probably paid the blood money from the public treasury.

This ḥadīth at HadeethEnc.comعن عمرو بن شعيب، عن أبيه، عن جده، قال: قضى رسول الله صلى الله عليه وسلم في رجل طعن رجلًا بِقَرْنٍ في رِجْلِهِ، فقال: يا رسول الله، أَقِدْنِي، فقال له رسول الله صلى الله عليه وسلم : "لا تعجل حتى يبرأ جرحك"، قال: فأبى الرجل إلا أن يَسْتَقِيدَ، فَأَقَادَهُ رسول الله صلى الله عليه وسلم منه، قال: فَعَرَجَ المُستَقيدُ، وبَرأ المُستقادُ منه، فأتى المُستَقِيدُ إلى رسول الله صلى الله عليه وسلم ، فقال له: يا رسول الله، عَرَجْتُ، وبَرَأَ صاحبي؟ فقال له رسول الله صلى الله عليه وسلم : "ألم آمرك ألا تستقيد، حتى يبرأ جرحك؟ فعصيتني فأبعدك الله، وبطل جرحك" ثم أمر رسول الله -صلى الله عليه وسلم، بعد الرجل الذي عرج- من كان به جرحٌ أن لا يستقيد حتى تبرأ جراحته، فإذا برئت جراحته استقاد.
‘Amr ibn Shu‘ayb reported from his father from his grandfather: The Messenger of Allah (may Allah's peace and blessings be upon him) judged a man who stabbed another man with a horn in his leg. The stabbed one said: "O Messenger of Allah, allow me retaliation." The Messenger of Allah (may Allah's peace and blessings be upon him) said: "Do not be hasty (but wait) until your wound heals." The man insisted that he wanted retaliation. Therefore, the Messenger of Allah (may Allah's peace and blessings be upon him) allowed him. Later, the one who insisted on retaliation became lame and the one against whom retaliation was brought recovered. The one who was allowed retaliation came to the Messenger of Allah and said: "I became lame and my companion recovered!" So, the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Did I not order you not to seek retaliation until your wound heals? However, you disobeyed me. May Allah keep you away (from recovery) and may your wound deserve no (blood money in) compensation." Then the Messenger of Allah (may Allah's peace and blessings be upon him) commanded anyone who is wounded not to seek retaliation until his wound heals. When his wound heals, he can seek retaliation. That was after the incident of that man who became lame.

This Hadīth tells the story of a man who hit another man with a horn from the skull of an animal. The victim asked the Prophet (may Allah's peace and blessings be upon him) to bring retaliation against the attacker. However, the Prophet (may Allah's peace and blessings be upon him) asked him to wait until his wound would heal, for it was unknown whether the wound would heal or the entire body would get affected, leading to death. However, the man insisted on retaliation. So the Prophet (may Allah's peace and blessings be upon him) allowed retaliation against the attacker, who later on recovered, whereas the victim became lame. The victim complained about that to the Prophet (may Allah's peace and blessings be upon him) who, therefore, told him that he was hasty and did not agree to delay the procedure, and so lost his right to the blood money. He prayed against him to discipline him for his hastiness and non-compliance with his order. Then, the Prophet (may Allah's peace and blessings be upon him) commanded that retaliation should be delayed until wounds heal.

This ḥadīth at HadeethEnc.comعن أنس أن الرُّبَيِّعَ عمته كَسَرَتْ ثَنِيَّةَ جارية، فطلبوا إليها العفو فأبوا، فعرضوا الأرْشَ فأبَوْا، فأتوا رسول الله صلى الله عليه وسلم وأبوا إلا القصِاَصَ فأمر رسول الله صلى الله عليه وسلم بالقصاص، فقال أنس بن النضر: يا رسول الله أَتُكْسَرُ ثَنِيَّةُ الرُّبَيِّعِ؟ لا والذي بعثك بالحق لا تُكسر ثنيتها. فقال رسول الله صلى الله عليه وسلم : «يا أنسُ، كتابُ اللهِ القصاصُ». فرضي القومُ فَعَفَوْا، فقال رسول الله صلى الله عليه وسلم : «إن من عباد الله من لو أقسم على الله لأبَرَّهُ».
Anas reported that his aunt, Ar-Rubayyi‘, broke the incisor of a girl. The aunt's family requested the girl's relatives for pardon, but they refused, then they proposed a compensation, but they refused. Then they went to the Messenger of Allah (may Allah's peace and blessings be upon him) and refused everything except retribution. So the Messenger of Allah (may Allah's peace and blessings be upon him) judged that retribution be applied. Anas ibn An-Nadr said: "O Messenger of Allah, will the incisor of Ar-Rubayyi‘ be broken? No, by the One Who sent you with the Truth, her incisor will not be broken." Therefore, the Messenger of Allah (may Allah's peace and blessings be upon him) said: "O Anas, the prescribed law of Allah is retribution." Thereupon, those people agreed on pardon. Then the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Among Allah's slaves, there are some who, if they take an oath by Allah (concerning something), Allah fulfills it."

Explanation
This Hadīth indicates that Ar-Rubayyi‘ (may Allah be pleased with her) broke some of the front teeth of a girl from the Ansār. So the Prophet (may Allah's peace and blessings be upon him) wanted that retribution be inflicted upon her, such that her equivalent front teeth be broken. However, her brother Anas ibn An-Nadr asked rhetorically, not denying the judgment of Allah, whether her teeth should be broken. He swore, out of good faith in Allah, that her teeth would not be broken. Nevertheless, the Prophet (may Allah's peace and blessings be upon him) reminded him that the divine judgment entails retribution. So when the victim's family saw that, they agreed to accept the compensation and gave up retribution. Hence, the Prophet (may Allah's peace and blessings be upon him) said that among the slaves of Allah, there are some people who, if they swear an oath, Allah fulfills it for them, owing to their righteousness and trust in Allah.
