عَنْ ابْنِ عُمَرَ رَضيَ اللهُ عنهُما أَنَّهُ سَمِعَ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَا حَقُّ امْرِئٍ مُسْلِمٍ لَهُ شَيْءٌ يُوصِي فِيهِ، يَبِيتُ ثَلَاثَ لَيَالٍ، إِلَّا وَوَصِيَّتُهُ عِنْدَهُ مَكْتُوبَةٌ»، قَالَ عَبْدُ اللهِ بْنُ عُمَرَ رضي الله عنهما: «مَا مَرَّتْ عَلَيَّ لَيْلَةٌ مُنْذُ سَمِعْتُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ ذَلِكَ إِلَّا وَعِنْدِي وَصِيَّتِي».
Ibn ‘Umar (may Allah be pleased with him and his father) reported that he heard the Messenger of Allah (may Allah's peace and blessings be upon him) say: "It is not proper for a Muslim who has something to bequeath to stay for three nights without having his will written with him." ‘Abdullah ibn ‘Umar (may Allah be pleased with him and his father) said: "Since I heard the Messenger of Allah (may Allah's peace and blessings be upon him) say this, not a single night has passed without my will being with me."

The Prophet (may Allah's peace and blessings be upon him) informed that a Muslim who has any rights or properties to bequeath, even if small, should not spend three nights without having his will written and ready with him. ‘Abdullah ibn ‘Umar (may Allah be pleased with him and his father) said: I have not spent a single night since I heard the Prophet (may Allah's peace and blessings be upon him) say that without having my will ready with me.
Benefits
- The legitimacy of making a will and hastening to do so as a means of clarifying it, adhering to the command of the Lawgiver, preparing for death, and contemplating its details and beneficiaries before being distracted by any obstacle.
- Wasiyyah (a will): It means a covenant whereby a person entrusts someone to handle something from his wealth after his death, assigns someone to care for his young children, or entrusts someone with any task or matter he owns after his death.
- The will is classified into three categories: 1. Recommended: A will that allocates part of one's wealth to be spent in charitable causes or acts of kindness, so the reward continues to reach him after his death. 2. Obligatory: A will that includes any owed rights, whether these are the rights due to Allah Almighty, such as unpaid Zakah, expiation, or similar obligations by Islamic law, or rights due to others, such as debts or entrusted items. 3. Prohibited: A will that exceeds one-third of one's wealth or includes a bequest to an heir.
- The merit of Ibn ‘Umar (may Allah be pleased with him and his father) and his hastening to do good deeds and adherence to the commands of the wise Lawgiver.
- Ibn Daqīq al-‘Eid said: Allowing two or three nights is to alleviate hardship and difficulty.
- Important matters should be documented in writing because it ensures greater accuracy and preserves rights more effectively.

قال: قلت: يا رسول الله أُخَلَّفُ بعد أصحابي؟ قال: إنك لن تُخَلَّفُ فتعمل عملا تبتغي به وجه الله إلا ازْدَدْتَ به درجة ورِفْعَةً، ولعلك أن تُخَلَّفَ حتى ينتفع بك أقوام، ويُضَرُّ بك آخرون.
اللهم أَمْضِ لأصحابي هجرتهم، ولا تَرُدَّهُم على أَعْقَابِهِم، لكنِ البَائِسُ سعد بن خَوْلَةَ (يَرْثِي له رسول الله صلى الله عليه وسلم أن مات بمكة).
Sa‘d ibn Abi Waqqās (may Allah be pleased with him) reported:
The Messenger of Allah (may Allah's peace and blessings be upon him) came to visit me for an illness which became so hard to bear in the year of the Farewell Hajj. I said: "O Messenger of Allah, you can see the severity of the illness which I am experiencing. I have property and none will inherit me except a daughter. Shall I give two thirds of my property in charity?" The Messenger of Allah (may Allah's peace and blessings be upon him) said: 'No.' I said: "Then shall I give one half, O Messenger of Allah?" He said: 'No.' Then I said: "So, (shall I give) one third?" The Messenger of Allah (may Allah's peace and blessings be upon him) said: "(Give) one third, and one third is too much. Indeed, leaving your heirs rich is better than leaving them poor and begging from people. You never spend anything seeking thereby the pleasure of Allah but that you are rewarded for it, even what you place in the mouth of your wife." I said: "O Messenger of Allah, will I be left here in Makkah after my companions have departed for Madīnah?" He said: "If you are left behind and do good deeds whereby you seek Allah's pleasure, you will be raised a degree and your status will be elevated on account of them. Perhaps you will be left behind so that some people may benefit by you and others may be harmed by you. O Allah, complete for my Companions their Hijrah (immigration to Madīnah), and do not turn them back on their heels. The unfortunate one, however, is Sa‘d ibn Khawlah." The Messenger of Allah (may Allah's peace and blessings be upon him) felt sorry for him, as he had died at Makkah.

Sa‘d ibn Abi Waqqās (may Allah be pleased with him) was severely ill during the Farewell Hajj, to the point that he feared death. The Prophet (may Allah's peace and blessings be upon him) visited him, as was his habit in looking after his Companions and caring for them. Sa‘d mentioned to the Prophet (may Allah's peace and blessings be upon him) what he thought would be good reasons for him to give most of his wealth in charity. He said: "O Messenger of Allah, I am very sick and fear death, I have much wealth, and I do not have vulnerable relatives that will inherit from me except my daughter. So can I give two thirds of my wealth in charity, after my daughter takes her share, so that I can put forward good actions for (my afterlife)?" The Prophet (may Allah's peace and blessings be upon him) said: 'No.' So, Sa‘d said: "Then shall I give one half, O Messenger of Allah?" He said: 'No.' So Sa‘d said again: "Shall I give one third?" Thereupon, the Messenger of Allah (may Allah's peace and blessings be upon him) told Sa‘d that there is nothing wrong with giving one third in charity, even though that is plenty. So giving less than that is better, such as a quarter or a fifth. Then the Prophet (may Allah's peace and blessings be upon him) explained to Sa‘d the wisdom behind reducing the amount of money given in charity by mentioning two points: 1. That he leaves his heirs wealthy and benefiting from his benevolence and wealth is better than him leaving them depending on the kindness of other people as a result of him giving his property to others than them. 2. Or that he stays alive and has his wealth, so he spends it in all the lawful ways, hoping for reward from Allah and being rewarded by Allah, even if he spends it in things that are obligatory on him, such as feeding his wife. Then, Sa‘d ibn Abi Waqqās (may Allah be pleased with him) feared that he might die in Makkah, from where he made his migration and had left for the sake of Allah, the Almighty, which might diminish his reward. So the Prophet (may Allah's peace and blessings upon him) informed him that he would not be forcibly left behind in a place that he migrated from, and that he should do good deeds seeking thereby the reward from Allah, and that Allah will raise him in rank. Then, he gave him the glad tidings that he would be cured from his illness and that Allah would benefit the believers through him and harm the disbelievers through him. It was exactly as he, the truthful and honest one, said: as Sa‘d was cured from his illness and became a chief in the war against the Persians. Allah benefited Islam and the Muslims through him, and he conquered many places, and He caused harm to polytheism and the polytheists through him. Then the Prophet (may Allah's peace and blessings be upon him) supplicated Allah for all his Companions that He would fulfill for them their rank, accept it from them, and not turn them away from their religion or the lands to which they migrated. Allah accepted that supplication from him, and to Him is all praise and favor. All praise is due to Allah, Who honored Islam through them. Then the Prophet (may Allah's peace and blessings be upon him) mentioned Sa‘d ibn Khawlah. He was from the people who migrated from Makkah, but Allah willed that he die in Makkah, and so he did. Therefore, the Prophet (may Allah's peace and blessings be upon him) felt pity for him that he died in Makkah, for they used to dislike for an immigrant to die in a place which they had migrated from.

‘Amr ibn Khārijah (may Allah be pleased with him) reported: The Prophet (may Allah's peace and blessings be upon him) delivered a sermon upon his she-camel, while I was under the front of her neck, and she was chewing her curd, with her saliva dripping between my shoulders. I heard him say: "Indeed, Allah has given everyone deserving a right his due right. So, there is no will for an inheritor. The child belongs to the bed, and the adulterer gets the stone. Whoever claims to belong to someone other than his father or (a freed slave) attributes himself to those other than his masters, spurning them, upon him will be the curse of Allah, and no obligatory or supererogatory act of worship will be accepted from him."

‘Amr ibn Khārijah (may Allah be pleased with him) reported that he was close to the Prophet (may Allah's peace and blessings be upon him) as he delivered a sermon from above his she-camel, whose saliva was dripping down upon ‘Amr's shoulders. He went on to relate that the Prophet (may Allah's peace and blessings be upon him) demonstrated a number of rulings in his sermon, as follows: 1. Allah, the Almighty, has allocated to each person his due right and designated share, and therefore it is not permissible to include an heir in the will. 2. The newborn belongs to the bed, i.e. the woman’s husband or master. The adulterer has no claim to the child; rather, he only deserves disappointment and the due punishment for his crime. 3. It is prohibited for a person to be attributed to other than his father or a slave to other than his masters who set him free. The Hadīth makes it clear that whoever does so shall be subject to the curse of Allah, the Almighty, and that Allah shall not accept any act of worship from him, be it obligatory or supererogatory.

This ḥadīth at HadeethEnc.comعن حنظلة بن حِذْيَم، أن جدَّه حَنِيفَة قال لحِذْيَم: اجمع لي بنيَّ، فإني أريد أن أُوصِي، فجَمَعهم، فقال: إنَّ أوَّل ما أوصي أنَّ ليَتِيمي هذا الذي في حَجْري مائة من الإبل، التي كنا نُسمِّيها في الجاهلية: المُطَيِّبة، فقال حِذْيَم: يا أبَتِ، إني سمعت بَنِيك يقولون: إنما نُقِرُّ بهذا عند أَبِينا، فإذا مات رجَعْنا فيه، قال: فبَيْني وبيْنكم رسول الله صلى الله عليه وسلم ، فقال حِذيم: رَضِينا، فارْتَفَعَ حذيم، وحنيفة، وحنْظَلَة معهم غُلام، وهو رَدِيف لحذيم، فلما أتوا النبي صلى الله عليه وسلم ، سلَّموا عليه، فقال النبي صلى الله عليه وسلم : «ما رَفَعَك يا أبا حذيم؟» قال: هذا، وضرَب بيده على فَخِذ حذيم، فقال: إني خَشِيتُ أن يَفْجَأَني الكِبَر، أو الموْت، فأردتُ أن أوصي، وإني قلتُ: إن أوَّل ما أوصي أن ليتيمي هذا الذي في حَجْري مائة من الإبل، كنا نُسَمِّيها في الجاهلية: المُطَيِّبة، فغَضِب رسول الله صلى الله عليه وسلم ، حتى رأَيْنا الغضب في وجهه، وكان قاعدًا فجَثَا على ركبتيه، وقال: «لا، لا، لا الصدقة خمس، وإلا فعشر، وإلا فخمس عشرة، وإلا فعشرون، وإلا فخمس وعشرون، وإلا فثلاثون، وإلا فخمس وثلاثون، فإن كَثُرت فأربعون» ، قال: فودَّعوه ومع اليتيم عصا، وهو يَضْرب جملا، فقال النبي صلى الله عليه وسلم : «عَظُمَت هذه هراوة يتيم» ، قال حنظلة: فَدَنا بي إلى النبي صلى الله عليه وسلم ، فقال: إنَّ لي بَنِين ذوي لِحى، ودون ذلك، وإنَّ ذا أصغرُهم، فادع الله له، فَمَسَح رأسه، وقال: «بارك الله فيك» ، أو «بورك فيه» ، قال ذَيَّالٌ: فلقد رأيتُ حنظلة، يؤتى بالإنسان الوارِم وجهه، أو بالبهيمة الوارِمة الضَّرع، فيَتْفُل على يديه، ويقول: بسم الله، ويضع يده على رأسه، ويقول على موْضِع كف رسول الله صلى الله عليه وسلم ، فَيَمْسحه عليه، وقال ذيال: فَيَذْهب الوَرَم.
Hanzhalah ibn Hidhyam reported that his grandfather Haneefah said to Hidhyam: "Gather my children for me, because I want to leave a testament." When they were gathered, he said: "The first thing I bequeath is that this orphan of mine who is in my custody is entitled to one hundred camels, which were called Al-Mutayyabah (the good favored ones) in pre-Islamic times.'' Hidhyam said: "O my father, I heard your children say: 'We will approve of this during our father's life, but when he dies, we will recant it.'" He said: "So let the Messenger of Allah (may Allah's peace and blessings be upon him) judge between me and you." Hidhyam said: "We accept that." So Hidhyam, Haneefah, and Hanzhalah along with a young boy who escorted Hidhyam set forth. When they came to the Prophet (may Allah's peace and blessings be upon him) they greeted him. The Prophet (may Allah's peace and blessings be upon him): "What made you come, Abu Hidhyam?" He replied, having struck Hidhyam on the thigh: "I fear that old age or death will overtake me, so I wanted to make a bequest. I therefore said: 'The first thing I bequeath is that this orphan of mine who is in my custody is entitled to one hundred camels, which were called Al-Mutayyibah in pre-Islamic times.'" The Messenger of Allah (may Allah's peace and blessings be upon him) became so angry that we saw anger in his face. He was sitting, but he knelt down and said: "No, no, no! A charity should consist of five camels, or else ten, or else fifteen, or else twenty, or else twenty-five, or else thirty, or else thirty-five, or of a maximum of forty." They fared him well, and the orphan had a stick with him with which he was beating a camel. So the Prophet (may Allah's peace and blessings be upon him) noted: "That is a too big a stick for an orphan." Hanzhalah said: "My father drew me closer to the Prophet, may Allah's peace and blessings be upon him and said: 'I have sons with beards, and others younger than them, and this one is the youngest. So pray for him.'" Therefore, he wiped his head and said: "May Allah bless you," or: "May he be blessed." Dhayyāl said: "I have seen Hanzhalah, and a man with a swollen face or a beast with a swollen udder would be brought to him. He would spit on his hands and say "Bismillāh" (in the name of Allah); put his hand on his head, where the Messenger of Allah (may Allah's peace and blessings be upon him) had placed his hand; and then wipe [the affected part] with it." Dhayyāl said: "The tumor would disappear."

Explanation
Hanzhalah ibn Hidhyam ibn Hanīfah narrates that his grandfather Hanīfah ordered his son Hidhyam to gather his children for him because he wanted to leave a testament before his death. The children gathered, and he told them that the orphan who was in his custody should be given one hundred camels. Before Islam, these camels were called the Mutayyabah, meaning: good camels that people liked for being from among the best camels. Hidhyam told his father that he heard his siblings say that they would approve of their father's will but that they would recant it on his death and would not give the orphan anything. So Hanīfah said that the Messenger of Allah (may Allah's peace and blessings be upon him) would judge between them. Hidhyam said that they were fine with the prospective judgment of the Prophet, may Allah's peace and blessings upon him. So Hidhyam; Hanīfah; and Hanzhalah, the son of Hidhyam — escorting his father — went to the Prophet (may Allah's peace and blessings be upon him) and greeted him. He asked Hanīfah (the father of Hidhyam) what had made him come over to him. Hanīfah pointed to Hidhyam, remarking that he feared that he would die before leaving a testament. He added that the first point of the bequest was that the orphan who was in his custody should be given one hundred camels, which were called, before Islam, the good and favorable ones. On that account, the Messenger of Allah (may Allah's peace and blessings be upon him) became so angry that they discerned that in his face. He changed his sitting position and knelt down. He said that a charity should consist of five camels, or else ten, or else fifteen, or else twenty, or else twenty-five, or else thirty, or else thirty-five, or a maximum of forty. He meant that charity is allowed if it does not exceed the third of one's wealth. They left him, and the orphan had a stick with him wherewith he drove a camel. So the Prophet (may Allah's peace and blessings be upon him) remarked that such a stick was too big for an orphan. By this, he meant that the orphan was a man of a big stature, and it was an exaggeration to call him an orphan, for he was not that young. Hanzhalah said that his grandfather drew him closer to the Prophet (may Allah's peace and blessings be upon him) and said that he had old bearded sons and younger children, and the youngest of them was Hanzhalah, so he asked the Prophet (may Allah's peace and blessings be upon him) to pray for him. The Prophet (may Allah's peace and blessings be upon him) wiped his head and invoked Allah's blessings on him. Dhayyāl, a narrator of this Hadīth, said that he later saw Hanzhalah being brought a man with a swollen face or a beast with sore udders, so he would spit on his hand; say: Bismillāh" (in the name of Allah); put his hand on his head where the Prophet (may Allah's peace and blessings be upon him) had put his hand; and then wipe the affected part of the man or beast, and the tumor would disappear.
